Identification of the Owner and General Information

Renne Bleu is the trade name of the company. These Terms and Conditions govern access to and use of the website https://rennebleu.fr (hereinafter, the Website) owned by COOL CHRISTMAS CLOTHING SL (hereinafter CCCSL), with C.I.F. B42975615 and registered office at Calle Plaza Castilla 3, 14 E1, 2, 28046, Madrid (Spain), as well as the services and products offered by CCCSL on its Website.
CCCSL offers this Website subject to these Terms and Conditions. By visiting the Website or using the services or applications of the Website, the user accepts these Terms and Conditions.
Access to the Website will not require User registration. However, to be able to contract any of the services offered by CCCSL, the User may be asked to register and accept these conditions before formalising payment.
Through the Website, CCCSL offers Users sustainable and ecological clothing.
These CCCSL Terms and Conditions set out below define the rights and obligations of CCCSL and Users within the Website framework. These are the only Terms and Conditions applicable to the use of the Website (without prejudice to specific conditions that may exist for certain services) and to the ordering of purchases through the Website, and they replace any other conditions, unless previously agreed in writing between CCCSL and the User.
These Conditions of Use and Contracting, as well as our Privacy Policy and Cookie Policy, are accepted by the user by the mere use of the website and/or the contracting of any of the products and/or services contained therein.

CCCSL reserves the right to modify all or part of these clauses, the provisions in force at any given time being those binding the user both in the use of the website and in the purchases made therein.

Accordingly, the user undertakes not to use the website for any unlawful purpose or in contravention of any applicable regulation.

Without prejudice to that established in the Privacy Policy, the user is informed that the electronic documents relating to the formalisation of transactions are stored by CCCSL for compliance with the legal provisions applicable to it, and may request a copy thereof via info@rennebleu.fr.

User Data

To purchase the products offered through the Website, it will not be strictly necessary for the User to register via the registration form available on the Website; they may purchase without registering and without any obligation to do so.
On the Website, all pages and data are protected for the user by an SSL (Secure Sockets Layer) security certificate; therefore, the data entered is secure.
The User will be responsible for maintaining the confidentiality of the data and information provided and for restricting access to their computer and access keys to avoid possible unauthorised use.
If the User has reason to believe that their data has become known to a third party, or has been used in an unauthorised manner, or is likely to be, they must inform CCCSL of this situation immediately.
The User must verify that their data is correct and complete and inform CCCSL whenever there is any change and/or modification to the information provided during the purchase process.

Conditions of Sale

The services and products offered via CCCSL’s Website are intended for purchase by Renne Bleu Users.
To place an order with CCCSL, the User must be over 18 years of age.
To place orders through the Website, the User must provide a series of data prior to contracting, via the purchase form, which will be necessary in order to manage the purchase order.

Payment Methods

Once the form data has been completed, the User must proceed to pay for the order through the payment methods specified on the Website.
We currently accept credit/debit card (Visa, Maestro, American Express, Mastercard…), PayPal, Shop Pay, Google Pay and Amazon Pay. Our transactions are secure and encrypted.
CCCSL is responsible for transactions through Shopify Payments gateways.
After payment has been made, the User will receive an order confirmation email, including a summary of the items purchased, the requested shipping method and the destination address.
If, at the time of payment, an incident occurs that prevents payment, the User will receive an automatic payment error message and the order will not be processed until the payment process is successfully completed.

Prices

The products offered on the Website, and their prices, will be available for purchase while they appear in the product catalogue displayed in the online store. In any case, CCCSL reserves the right to make any modifications it deems appropriate, and may update our products and services according to the market. The prices appearing on the website are subject to change.
Product and service prices are expressed in Euros (€), including taxes and handling and shipping charges, the amount of which will be indicated at the time of final confirmation of each order.
All prices shown are final prices, with Value Added Tax (VAT) expressly included, without prejudice to the fact that the user will at all times have itemised information on the product price. The final price of your order will be the result of adding up the amount of each product plus applicable taxes and fees. However, this final price will vary depending on the following circumstances: whether or not you have to pay shipping costs and whether you have a discount code.
CCCSL reserves the right to change prices without prior notice. However, after receiving the order confirmation, the prices to be paid for that order will not be affected.

CCCSL informs the User that despite updates made to product prices offered on the Website, they may contain errors. We will promptly correct any errors that appear, but such errors will not be binding.

Prices shown on the website based on an obvious typographical error, for example products published at zero euros or at an insignificant, minimal or derisory price (or absolutely disproportionate to their market value), will not form part of the order when such error was known to the User at the time of purchase and the User acted in bad faith.

Discount Codes

CCCSL may periodically offer discount codes to its Users. Such discounts may only be applied in accordance with the instructions specified by CCCSL for each code, and in any event Users may use only one code per order. Each discount code may be used once per user.
The use of discount codes will not be compatible with certain promotional actions and collections.
Promotional codes will be valid until the date indicated in the communication in which they are announced (emails, social networks, customer service channels, etc.). In the absence of an explicit date, CCCSL reserves the right to cancel any code without prior notice.

The general conditions of purchase, exchanges and returns will apply to any order in which a promotional code has been used.

Discount codes cannot be exchanged for cash.

Shipping

Preparation of the order and subsequent shipment of purchased products will only be carried out when full payment has been made and received. Until payment is received, the purchase will not be deemed completed.

Shipping Costs

From the Website, CCCSL provides the User with the Shipping service with the following country rates:

• Shipments to Spain and Portugal: cost €2.99 and delivery time 24–48 working hours from the time the order is prepared. This service is free for orders over €30.

• Shipments to France, Belgium and Monaco: cost €4.99 and delivery time 48–72 working hours from the time the order is prepared. This service is free for orders over €40.

• Shipments to the United Kingdom, Ireland, Germany, Italy and Poland: cost €6.99 and delivery in 3–5 working days from the time the order is prepared. This service is free for orders over €50.

• Shipments to the United States: cost $9.99 and delivery time 4–6 working days from the time the order is prepared. This service is free for orders over $100.

CCCSL establishes that the order preparation schedule is Monday to Friday from 9:00 a.m. to 4:00 p.m., except national holidays. All orders completed via the Website outside the preparation schedule will be prepared and shipped the next working day.
No shipments will be made to P.O. boxes.
CCCSL reserves the right not to ship to island areas or autonomous cities.
CCCSL reserves the right not to ship to any country not indicated above.

Delivery

Orders will be delivered to the delivery address freely designated by the User, within the timeframes mentioned above. These timeframes may be longer during sales, Black Friday, Christmas or specific promotions.

CCCSL assumes no responsibility when delivery of the order placed via the Website cannot be made due to data provided being false, inaccurate or incomplete, or when delivery cannot be made for reasons beyond CCCSL’s control such as absence of the recipient, customs retention, traffic accidents or weather incidents. In no case will this delay entail the obligation to pay any compensation.

For the purposes of these Conditions, delivery will be deemed completed when the User, or a third party duly designated by the User, takes physical possession of the Products, which will be evidenced by personal identification upon receipt of the order at the delivery address indicated by the User.

Returns Policy, Exchanges, Defective Products, Cancellations and Order Modifications. Right of Withdrawal

Modifications and Cancellations

Modifications or cancellations of an order placed by the User via the Website are possible provided that said order has not been prepared. If the order has already been prepared, CCCSL reserves the right to modify or cancel said order. In no case will it be possible to modify or cancel an order that has already been shipped.

In any case, it is the User’s responsibility to contact CCCSL through any of the channels available on the Website. CCCSL will do its best to carry out the requested modification or cancellation before the order is prepared and shipped. In no case will CCCSL assume any responsibility if it is not possible to make the modification or cancellation requested by the User and the order is prepared and shipped.

Size Exchanges

The User has the right to request a size exchange of a product in their order placed through the Website within 14 calendar days from the day on which the consumer or a third party indicated by them, other than the carrier, received the order.

The User may request a size exchange through the channels available on the Website, where they will be informed how to proceed. CCCSL reserves the right to modify the procedure for size exchanges without prior notice.
CCCSL will not accept a size exchange for garments that, once received in the warehouse, show signs of use, emit bad odours or have any defect that was not notified by the User within 48 hours following delivery. In such a case, the size exchange request will be cancelled.
Second exchange policy: in the event of a second exchange request, a fee of €5.99 will be payable for management and transportation costs.

During the size exchange process, CCCSL will deem the process completed if, 21 calendar days after the last communication with the User, CCCSL has not received a response via any of the communication channels available on the Website.

Model Changes

CCSL reserves the right to make model changes to products in orders placed through the Website. If the User wishes to change the model of a product they have purchased, they must request a return of that product and place a new order.

Defective Products

It is the User’s responsibility to check the external condition of the parcel(s) and to make all pertinent reservations at the time of receipt.

In case of severe damage to the parcel (opened, damaged…), it is advisable to refuse delivery. If, for any reason, it has not been possible to refuse the parcel, the User has 48 HOURS to contact CCCSL and file a claim indicating the defects with photos and videos of the material received, such as the box, the shipping label and the defective product in question.

Once more than 48 hours have elapsed from receipt of the order by the User, any return requested will be processed as a withdrawal return.

The User will use the communication and contact channels described on the Website to provide the necessary information. This information will be reviewed and, if the return is confirmed due to a flaw, defect or receipt of an incorrect product, CCCSL will arrange the collection of the item at no cost to the User and the reshipment of another identical product to the one the User had purchased.

Collection of the defective product will be carried out on the date agreed by the User and CCCSL, within working hours from 9:00 a.m. to 6:00 p.m. If the User expressly indicates that they do not wish to arrange the collection or if the arranged collection cannot take place due to the User’s absence, CCCSL will provide the option to drop off the parcel at a drop-off point.

Whenever a return due to flaw, defect or receipt of an incorrect product is confirmed, the replacement with the same product purchased by the User will proceed. Only if that product is sold out or out of stock and replacement is not possible may the User request an exchange for another product or a refund of the amount of the defective product.

Returns for manufacturing defect or flaw will not be processed for products showing defects or deterioration caused by external factors (accidents, wear and tear, misuse, improper handling), as well as products whose original form has been manipulated, altered or repaired by the customer or by third parties not authorised by us.

During the processing of a return due to flaw, defect or receipt of an incorrect product, CCCSL will deem the process completed if, 21 calendar days after the last communication with the User, CCCSL has not received a response via any of the communication channels available on the Website.

Right of Withdrawal

In accordance with EU regulations, the User has the Right of Withdrawal, under which they may return the product received if it does not meet their expectations within 14 calendar days from the day on which the consumer or a third party indicated by them, other than the carrier, received the order.

Pursuant to Article 103 of the Recast Text of the Consumer and User Protection Law, the right of withdrawal may not be requested with respect to the following products:

• Sealed products that are not suitable for return for reasons of health protection or hygiene (for example: underwear or face masks) and that have been unsealed after delivery.

• Products made to your specifications or clearly personalised.

• Items identified as gifts, for example, those sent free of charge or at no cost to the User.

CCCSL will not accept a return of garments that, once received in the warehouse, show signs of use, emit bad odours or have any defect that was not notified by the User within 48 hours following delivery. In such a case, the return request will be cancelled and the product will be shipped back to the User.
For accepted returns, the price of the product and the initial shipping costs will be refunded no later than fourteen (14) days after the day on which the product is received at CCCSL’s facilities.

The same means of payment used for the initial transaction will be used for the refund, unless the User indicates otherwise. In any case, the refund will not entail the obligation to pay any fee or commission.

The refund may be withheld until the items returned by the User have been received, or until proof of having returned the items is provided to us, whichever occurs first.

During the return process, CCCSL will deem the process completed if, 21 calendar days after the last communication with the User, CCCSL has not received a response via any of the communication channels available on the Website.

Information about Renne Bleu’s Products and Services

The data included on the Website in each product and service description, in their photographs, graphic or iconographic representations and videos, as well as trade names, trademarks or distinctive signs of any kind, serve a purely informative function. Therefore, CCCSL declines any responsibility for the appearance of errors in such information, while committing to take all measures within its reach to correct the said errors or omissions as soon as possible after being informed of them.

Use of the Website

Use of the Website for fraudulent purposes, or in connection with criminal offences or unlawful activities of any kind is not permitted. It is also prohibited to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or threatening, or that constitutes a violation of intellectual property rights, trademarks, confidentiality, privacy or any other right, or is otherwise harmful or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising content, chain letters, mass mailings or any other type of spam, and, in general, any unnecessary nuisance or inconvenience.
The User undertakes to make lawful, diligent, honest and proper use of any information or content to which they have access either through the Website or third-party websites accessible via links from the Website, all under the principles of good faith and with respect at all times for current legislation and these Terms and Conditions.
Likewise, the User undertakes not to cause, maliciously or intentionally, damage that may undermine or alter the Website itself and not to introduce or disseminate computer viruses that may cause unauthorised alterations to the content or systems that make up the Website.
CCCSL reserves the right to deny access to the Website or even cancel orders to Users who misuse the content and/or fail to comply with any of the conditions set out in this document.

Intellectual or Industrial Property

The intellectual property rights of the page https://rennebleu.fr, its source code, design, navigational structures and the different elements contained therein are owned by CCC SL, which holds the exclusive rights to exploit them in any way and, in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with applicable Spanish and European legislation. CCCSL informs that it does not grant any licence or express or implied authorisation over the intellectual and/or industrial property rights or over any other right or property related, directly or indirectly, to the content included on the Website. Total or partial reproduction of the Website content is strictly prohibited, even via a hyperlink, without the express written consent of CCCSL. Unauthorised use of such content will give rise to legally established liabilities.

Hyperlinks

The hyperlinks contained on the Website may lead to third-party web pages. CCCSL assumes no responsibility for the content, information or services that may appear on such sites, which are understood to be offered for information purposes only by CCCSL, and which in no case imply any relationship, acceptance or endorsement between CCCSL and the owners of such content or the owners of the sites where they are found.

Partial Nullity

If any Clause of these Terms and Conditions is declared null, the remaining Clauses will remain in force and will be interpreted taking into account the spirit of these Terms and Conditions.

Modifications

The information appearing on this Website is that in force on the date of its last update. CCCSL reserves the power to unilaterally modify these Terms and Conditions, as well as its privacy policy and any other information. The entry into force of modifications to the Terms and Conditions will occur from the moment of their publication on this Website.

Notifications

All communications between CCCSL and the User relating to the contracting of orders through the Website will be made in writing and in accordance with the communication procedures established in these Terms and Conditions for each particular case.

During the processing of a size exchange or a return, CCCSL will deem the exchange or return completed if, 21 calendar days after the last communication with the User, CCCSL has not received a response via any of the communication channels available on the Website.

Language

CCCSL may translate these Terms and Conditions, its Privacy Policy, or any other operating rule, policy or procedure that may be published on the Website. The Spanish-language version will prevail in case of conflict.

Applicable Law and Jurisdiction

These Terms and Conditions are subject to Spanish law. The parties, in accordance with Royal Legislative Decree 1/2007, of 16 November, approving the recast text of the General Law for the Defence of Consumers and Users and other supplementary laws, submit to the Courts and Tribunals of the User’s place of residence.
Likewise, pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution in consumer matters, CCCSL informs you that, in the event of a dispute, the User resident in the European Union may refer to the “Online Dispute Resolution Platform” developed by the European Commission, in order to attempt to resolve extrajudicially any dispute arising from the provision of services by CCCSL.
